Right of withdrawal for consumers

(Consumer means any natural person who enters into a legal transaction for purposes that predominantly cannot be attributed to their commercial or independent professional activity.)

You have the right to withdraw from this contract within 30 days without giving any reason.

The withdrawal period is 30 days from the day,

- on which you or a third party named by you, who is not the carrier, took possession of the goods, provided you ordered one or more goods as part of a single order and they are delivered uniformly;

- on which you or a third party named by you, who is not the carrier, took possession of the last good, provided you ordered multiple goods as part of a single order and they are delivered separately;

- on which you or a third party named by you, who is not the carrier, took possession of the last partial shipment or the last piece, provided you ordered goods that are delivered in several partial shipments or pieces;

To exercise your right of withdrawal, you must inform us (SGH Handelsgesellschaft mbH, Wöllnitzer Str. 56, 07749 Jena, phone number: +49 3641 297 8804, email address: service@gorillagesund.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Note: Please note that you must return each item in the condition in which you received it. This means that new items must also be new, unused, and complete when you return them. Used items must not show additional signs of use or damage. This also applies to the packaging. Please unpack the package carefully and do not seal it excessively when returning it. Otherwise, a full refund cannot be guaranteed.

Consequences of withdrawal

If you withdraw from this contract, we must refund you all payments received from you, including delivery costs (except for the additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without delay and no later than 30 days from the day on which we received the notification of your withdrawal from this contract. We will use the same means of payment for this refund that you used for the original transaction unless expressly agreed otherwise with you; in no case will you be charged fees for this refund.

We may withhold the refund until we have received the goods back or you have provided proof of having sent back the goods, whichever is earlier.

You must return or hand over the goods to us (SGH Handelsgesellschaft mbH, Wöllnitzer Str. 56, 07749 Jena, phone number: +49 3641 297 8804, email address: service@gorillagesund.de) without undue delay and in any event no later than 30 days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of 30 days has expired.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion or expiration reasons

The right of withdrawal does not exist for contracts

- for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;

- for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded;

- for the delivery of alcoholic beverages, the price of which was agreed upon at the time of contract conclusion, but which can only be delivered at the earliest 30 days after contract conclusion and whose current value depends on fluctuations in the market over which the entrepreneur has no influence;

- for the delivery of newspapers, magazines, or illustrated magazines except for subscription contracts.

The right of withdrawal expires prematurely for contracts

- for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery;

- for the delivery of goods that are inseparably mixed with other goods after delivery due to their nature;

- for the delivery of audio or video recordings or computer software in a sealed package if the seal was removed after delivery.
