Right of Withdrawal for Consumers

(Consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity.)

Right of withdrawal

You have the right to withdraw from this contract within 30 days without giving any reasons.

The withdrawal period is 30 days from the day,

- at which you or a third party named by you, who is not the carrier, have taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered uniformly;

- at which you or a third party named by you, who is not the carrier, have taken possession of the last item, provided that you have ordered multiple items as part of a single order and these are delivered separately;

- on which you or a third party named by you, who is not the carrier, have taken possession of the last partial shipment or the last piece, provided that you have ordered a product that is delivered in several partial shipments or pieces;

To exercise your right of withdrawal, you must contact us (SGH Handelsgesellschaft mbH, Wöllnitzer Str. 56, 07749 Jena, Phone no.: +49 3641 297 8804, Email address: service@gorillagesund.de) by means of a clear statement (e.g. a letter sent by post or an email) informing us of your decision to withdraw from this contract. You can use the attached sample withdrawal form for this purpose, but it is not mandatory.

To maintain the cancellation period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the cancellation period expires. 

Note: Please be aware that you must return each item in the condition in which you received it. This means that new items must also be new, unused, and complete when you return them. Used items must not show any additional signs of use or damage. This also applies to the packaging. Please unpack the package carefully and do not seal it excessively when returning. Otherwise, a full refund cannot be guaranteed.

Consequences of the revocation

If you revoke this contract, we will refund you all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a different type of delivery than the cheapest standard delivery offered by us), without delay and at the latest within 30 days from the day we receive your notice of revocation of this contract. For this refund, we will use the same payment method you used for the original transaction, unless something else has been expressly agreed with you; in no case will you be charged any fees for this refund.

"We can refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier."

You must return or hand over the goods to us (SGH Handelsgesellschaft mbH, Wöllnitzer Str. 56, 07749 Jena, Phone: +49 3641 297 8804, Email: service@gorillagesund.de) without delay and in any case no later than 30 days from the day you inform us of the cancellation of this contract. The deadline is met if you send the goods before the 30-day period has expired.

"You bear the direct costs of returning the goods."

"You are only liable for any potential loss in value of the goods if this loss in value is attributable to handling them in a manner that is not necessary for the examination of their nature, characteristics, and functioning."

Exclusion or termination reasons

The right of withdrawal does not exist for contracts

- for the delivery of goods that are not pre-fabricated and for whose production an individual choice or specification by the consumer is significant or that are clearly tailored to the personal needs of the consumer;

- for the delivery of goods that can quickly spoil or whose expiration date would be quickly exceeded;

- for the delivery of alcoholic beverages, the price of which was agreed upon at the conclusion of the contract, but which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market that the entrepreneur cannot influence;

- for the delivery of newspapers, magazines or illustrated publications, with the exception of subscription contracts.

The right of withdrawal expires prematurely in the case of contracts

- for the delivery of sealed goods that are not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery;

- for the delivery of goods, if they have been inseparably mixed with other goods due to their nature after delivery;

- for the delivery of audio or video recordings or computer software in a sealed package, if the seal has been removed after delivery.
